Terms of service of melon.edu.pl

1. General provisions

  1. These terms set out the rules for using the website melon.edu.pl (the “Site”) and are the terms referred to in Article 8 of the Polish Act of 18 July 2002 on providing services by electronic means.
  2. The service provider is Nublado sp. z o.o., ul. Henryka Sienkiewicza 3, 80-227 Gdańsk, Poland, entered in the Register of Entrepreneurs of the National Court Register by the District Court Gdańsk-Północ in Gdańsk, 7th Commercial Division of the National Court Register, under KRS 0001050386, NIP (tax ID) 9571161497, REGON 525989527, share capital PLN 10,000 (the “Provider”). Contact: info@melon.edu.pl.
  3. A user is anyone who uses the Site (the “User”).
  4. These terms apply only to the Site and do not govern the use of the Melon app.

2. Services

  1. Through the Site, the Provider offers the following services by electronic means:
    • access to information about the Melon app,
    • a sign-up form for the Melon pilot, through which a club, school, parent or other person can express interest in taking part in testing.
  2. The services are free of charge.
  3. Sending a sign-up does not create an agreement to use the Melon app and does not guarantee a place in the pilot. The Provider replies to sign-ups at its discretion, depending on the places available in the pilot.

3. Technical requirements

  1. To use the Site you need a device with internet access and an up-to-date web browser.
  2. To send a sign-up you need JavaScript enabled in your browser and an active email address.
  3. Using the internet carries typical risks such as malware, phishing or interception of data in transit. The Site only connects to Users over encrypted HTTPS. The Provider never asks for passwords or payment details through the Site.

4. Conclusion and termination of the agreement

  1. The agreement to provide the Site's content is concluded when the User opens the Site and ends when the User leaves it.
  2. The agreement to use the form is concluded when the User starts filling it in and is performed when the sign-up is sent. The User may withdraw the sign-up at any time, without giving a reason and at no cost, by writing to info@melon.edu.pl.

5. Rules of use

  1. The User uses the Site in accordance with the law and good practice.
  2. It is prohibited to submit unlawful content through the Site, to enter another person's data in the form without authorisation, and to disrupt the Site, including by sending the form in bulk.
  3. The Provider may delete a sign-up that breaches these rules.

6. Complaints

  1. Complaints about how the Site works can be sent by email to info@melon.edu.pl or by post to the Provider's registered office.
  2. A complaint should include the User's contact details and a description of the problem.
  3. The Provider handles a complaint within 14 days of receiving it and replies the same way it was sent, unless the User asks otherwise.

7. Personal data

How personal data is processed is described in the privacy policy.

8. Rights to content

The Site's content, including texts, graphics, app screenshots and the Melon logo, is protected by copyright and belongs to the Provider or is used with the permission of the rights holders. Copying or distributing it beyond permitted use requires the Provider's consent.

9. Final provisions

  1. The Provider may change these terms for important reasons, in particular a change in the law or in the scope of the services. The amended terms will be published on the Site with a new effective date and do not affect sign-ups sent earlier.
  2. These terms are governed by Polish law. This choice of law does not deprive a consumer of the protection afforded by the mandatory provisions of the country of their habitual residence.
  3. A User who is a consumer may use out-of-court complaint and redress procedures, for example by contacting a municipal or district consumer ombudsman (rzecznik konsumentów) or a regional inspectorate of the Trade Inspection (Inspekcja Handlowa). Information about these procedures is available on the website of the Office of Competition and Consumer Protection (uokik.gov.pl).
